How Can War Have Laws?: War in History, Jewish Tradition, and International Law
view options Since October 7th, phrases like “war crimes” and words like “genocide” have been tossed around in ways completely disconnected from definitions, understandings, and facts. In response, this course asks: When is war lawful?; Who or what are legitimate targets?; What constitutes genocide?; What obligations do militaries have to enemies? And, importantly, from a Jewish lens: what have Jewish Law (Halakhah) and the Jewish tradition taught about acceptable wars and acceptable ways of conducting them?Let's looks at the fascinating history of the laws of war, examining their development from ancient times, to today's international law, with a particular focus on war in Jewish law and tradition from the Bible, Talmud, Maimonides to the modern era. For nearly two millennia this was merely a theoretical question for a people without a state. Post-1948 it has become a real and viable issue, one that has brought forth religious and secular responses, culminating in the IDF’s doctrine of “Purity of Arms.”
